Kalshi Expands with Tribal Partnerships, Deepening Gaming Industry Rift

Prediction market operator Kalshi has entered into partnerships with four Native American tribes, marking a significant expansion of its presence in tribal gaming. The Kletsel Dehe Wintun Nation, Greenville Rancheria, and Alturas Indian Rancheria in California, along with the Alabama-Quassarte Tribal Town in Oklahoma, announced the deals this week. Each tribe will launch its own branded app, controlling the customer-facing side while Kalshi manages the underlying exchange and trade operations. These agreements come shortly after a similar deal between Kalshi and the Tunica-Biloxi Tribe of Louisiana.

Growing Divide Among Tribes Over Prediction Markets

The new partnerships have highlighted divisions within Native American communities regarding prediction markets. Some tribal leaders see these deals as an opportunity for economic development and increased revenue, especially for tribes with limited access to traditional casino gaming. Others, particularly established tribal gaming organizations, have voiced strong concerns that prediction markets could threaten existing casino revenue and undermine tribal gaming rights.

Only one of Kalshi's new partners, Alturas Indian Rancheria, operates a casino. For the others, prediction markets are seen as a way to address economic challenges and fund essential projects, such as water infrastructure. However, critics argue that such partnerships could be viewed as an endorsement of products they believe are illegal, potentially weakening tribal legal efforts against Kalshi.

Legal and Regulatory Disputes Intensify

The controversy centers on whether Kalshi's event contracts should be classified as gambling, subject to tribal and state gaming laws, or as financial instruments under federal oversight. Kalshi maintains that its products are regulated by the Commodity Futures Trading Commission (CFTC), while tribal gaming groups argue these contracts amount to unauthorized sports betting and infringe on rights protected by federal Indian gaming laws.

Recent court rulings have produced mixed outcomes. Two California tribes secured a federal appeals court victory against Kalshi and Robinhood over sports contracts on tribal land, while a judge in Wisconsin declined to halt Kalshi's operations within the Ho-Chunk Nation, citing insufficient evidence of harm to casino revenues.

Why This Matters for Industry Stakeholders

For operators, affiliates, and suppliers, the expansion of prediction markets into tribal territories signals potential shifts in the competitive landscape. The legal ambiguity around event contracts presents both risks and opportunities, particularly as some tribes seek new revenue streams while others defend established gaming operations. Regulatory clarity will be crucial as more tribes consider partnerships and as federal and tribal authorities vie for oversight. For affiliates, the emergence of tribal-branded prediction market apps could open new channels, but also introduces compliance complexities.
