The Common Court of Curaçao has issued an interim ruling in favor of five players who filed a lawsuit against the iGaming operator Usoftgaming N.V. The players had transferred their claims to the Curaçao fund SBGOK and are seeking the return of their lost funds.
Usoftgaming argued that a clause in its user agreement prohibited players from transferring claims to third parties. However, the court deemed the agreement invalid.
The basis for this ruling was the inability to prove that clients could retain a copy of the agreement text at the time of registration, as required by Curaçao's electronic contract law. The court noted that once the agreement was annulled, the brand could no longer contest the transfer of claims to the fund.
Additionally, the operator was ordered to refund one player £8,750 (approximately $11,800) in unpaid cashback. The claims of the other players will be reviewed after September 29.
