The Common Court of Curaçao has rejected the appeal of iGaming operator NGame N.V. and upheld a German ruling regarding the return of €94,999.83 to a player. The operator, which operates under a sublicense from a Curaçao license holder, sought to overturn the decision, citing local regulations that prohibit the reclamation of voluntarily lost funds.
Previously, a German court sided with the player in a dispute against NGame N.V., which had been operating in the country without a local license. In October 2023, the Baden-Baden District Court declared the operator's contracts with the player void. Subsequently, in April 2024, the Higher Regional Court of Karlsruhe dismissed NGame's appeal. Following this, the operator approached the Common Court of Curaçao, requesting that the German ruling not be recognized on the island.
The Curaçao court clarified that it had compared the German ruling with contemporary principles of local law and did not assess whether the German court had resolved the dispute correctly.
