Spribe Faces Legal Setback in Brazil Over Aviator Trademark

The provider Spribe announced on LinkedIn that it has received a preliminary injunction from the Pernambuco State Court (TJPE) against the operator Betnacional (NSX Brasil S.A., Flutter Entertainment) regarding the use of the Aviator trademark, which is registered by Spribe with the Brazilian patent institute INPI.

According to Spribe, Betnacional has been using the Aviator brand since 2022. However, in 2025, they introduced a game with the same name from Aviator Studio, which Spribe claims is an unauthorized reproduction of the original Aviator developed in late 2018.

As reported by iGN, the TJPE registry data for case 0111453-89.2025.8.17.2001 (Spribe OÜ vs NSX Brasil S.A., subject Trademark) does not support the provider's claims. According to the court's decision on March 4, 2026, the request for a preliminary injunction by Spribe was denied, citing insufficient evidence to justify the claim at this procedural stage. As of the time of publication, there are no records of an appeal against the first instance decision.
