Rio de Janeiro Bans Outdoor Advertising for Online Betting

The City Hall of Rio de Janeiro has enacted a ban on outdoor advertising for fixed-odds betting platforms and online gambling services throughout the city. This decision is formalized under Rio Decree No. 58,274, which was issued on July 10, 2026, and is effective immediately.

This decree encompasses various advertising formats, including structures, street furniture, and any public spaces that require municipal licenses or permits. Advertisers are mandated to eliminate existing ads and modify authorized advertising devices to align with the new regulations. A grace period of 10 days from the decree's publication has been established, during which fines will not be enforced.

The Licensing and Inspection Coordination Office (CLF) is tasked with ensuring compliance and has the authority to demand the prompt removal of any advertisements that do not adhere to the new rules. Violators, including both advertisers and display companies, may face penalties as outlined in Article 124 of Law No. 691, amended by Complementary Law No. 269 in December 2023. This could lead to the immediate revocation of advertising licenses or authorizations, in addition to other legal repercussions.

The restrictions apply broadly to trademarks, business names, digital platforms, websites, applications, and any promotional activities related to betting, including bonuses and incentives. It also covers logos, symbols, mascots, slogans, and any visual identifiers associated with licensed fixed-odds betting operations.

Municipal entities are required to enforce these restrictions during the execution or renewal of contracts and permits related to advertising on municipal property. The ban extends to any advertising campaigns or events that are sponsored or conducted by municipal authorities.

Additionally, the decree introduces Article 37-A to Rio Decree No. 55,648, which prohibits outdoor advertising for virtual fixed-odds betting at events, including any associated trademarks or graphic elements.

The City Hall emphasized its authority to regulate land use, urban planning, and advertising spaces within the municipality. It referenced various constitutional articles that prohibit advertising deemed offensive or harmful to individuals and society.

Furthermore, the decree highlights concerns regarding the mental health impacts of excessive exposure to gambling advertisements, particularly among youth. It cites Federal Law No. 14,790 as a legal basis for limiting gambling promotion.

Mayor Eduardo Cavaliere stated, 'The Rio de Janeiro City Hall will not permit outdoor advertising, which is regulated by the municipality and belongs to all Rio residents, to promote activities that lead to financial distress and harm families in Rio and across Brazil.'
