Key Developments in Prediction Markets and Gambling Legislation

This week, prediction markets are at the forefront of discussions within the gambling sector, particularly as gubernatorial decisions and legislative deadlines take center stage.

Several significant legal and legislative events are anticipated, including court rulings and actions from Capitol Hill and state governors.

One of the major stories to follow is Tennessee's upcoming opening brief in its appeal against Kalshi, which is due on May 18. This appeal was initiated in March after a lower court ruled in favor of Kalshi in February, preventing Tennessee regulators from enforcing actions against the company's sports-event contracts. Interestingly, the Sixth Circuit recently denied Kalshi’s request for an injunction in a separate case against Ohio, indicating skepticism towards some of Kalshi’s legal arguments.

Another key event is the Senate Commerce Subcommittee meeting scheduled for May 20, titled “No Sure Bets: Protecting Sports Integrity in America.” This meeting will focus on the integrity of sports betting amid rising concerns regarding match-fixing and insider information. Witnesses will include notable figures from the American Gaming Association and other industry leaders.

Additionally, there is ongoing debate regarding insider trading and the integrity of prediction markets, as tensions rise between state gambling regulators and the Commodity Futures Trading Commission (CFTC). The AGA's campaign against sports event contracts adds another layer to this complex dynamic.

In New York, Kalshi has requested a federal judge to consolidate the CFTC’s lawsuit with the state’s actions against cryptocurrency exchanges Coinbase and Gemini. New York has opposed this move, claiming that Kalshi is attempting to bypass procedural rulings.

Moreover, the CFTC has shown support for Kalshi in Ohio and is monitoring developments in other states, including Minnesota, where lawmakers recently included prediction market language in a public safety bill. Washington is also a state to watch, as a federal judge has returned a lawsuit against Kalshi to state court.

As for legislative deadlines, Minnesota and Alaska are approaching critical dates, with Minnesota lawmakers nearing their adjournment target of May 18. Recent legislative activity includes the passage of several gambling-related bills, although some, like the sweepstakes casino bill, seem to be stalled.
