In courts across New York, Michigan, and Washington, Kalshi encountered significant developments, with the Commodity Futures Trading Commission (CFTC) exercising its emergency powers for the first time in the ongoing Michigan case. Meanwhile, lawmakers are closely examining the burgeoning prediction market sector, even as companies venture into new products and distribution methods, highlighting the industry's resilience despite increasing legal and regulatory hurdles.

Ongoing Legal Battles in Prediction Markets

In Michigan, Judge Rosemarie Aquilina has extended Kalshi’s temporary restraining order, rejecting the company's claims that it operates outside the realm of gambling. She emphasized that Kalshi is engaged in gambling activities, which states have historically regulated. Furthermore, the court imposed a deadline of August 12 for Kalshi to geofence the state or incur daily fines of $500,000.

In New York, Kalshi has requested an injunction pending appeal after Judge Analisa Torres denied its earlier request for a preliminary injunction. The company argues that the ruling jeopardizes its operations and contradicts other court decisions that support the idea that federal commodities law supersedes state gambling regulations. New York has agreed to refrain from enforcement actions against Kalshi until July 30 while the request is under consideration.

In Washington, Kalshi's appeal is currently on hold as both the company and the state have requested a pause in proceedings until the Ninth Circuit resolves related cases from Nevada. These cases are pivotal as they address whether federal commodities law overrides state gambling laws in the context of CFTC-regulated event contracts.

American Gaming Association Joins Wisconsin Lawsuit

The American Gaming Association (AGA) has sought to intervene in the federal lawsuit initiated by the CFTC against officials in Wisconsin. The AGA argues that the outcome of this case could have significant implications for state gaming regulations and the authority of licensed sportsbooks. While Wisconsin does not oppose the AGA's involvement, federal regulators are against it.

CFTC Actions and Industry Updates

The CFTC has mandated that Kalshi honor trades made in Michigan, utilizing its emergency powers to prevent the exchange from unwinding these transactions following the court's order. The regulator stated that allowing cancellations based on a customer's location could jeopardize market integrity and create confusion among participants.

This situation marks a notable instance of a state court attempting to reverse executed prediction market trades. In other news, the CFTC has approved Water Street Labs as a designated contract market (DCM), allowing it to list futures and swaps products. This approval introduces a new competitor in the expanding event contracts market. Additionally, the Intercontinental Exchange (ICE) has launched a new range of economic indicator futures contracts.
