Kalshi Faces Key Hearings as Gambling Bills Gain Momentum

This week marks a significant moment for Kalshi as it prepares for two important court hearings while lawmakers revisit gambling legislation and major operators disclose their Q1 earnings.

The legal proceedings surrounding prediction markets are at the forefront of this week's gambling news, particularly with Kalshi's hearings scheduled in Massachusetts and Maryland. In addition, major gaming companies such as Flutter, DraftKings, and Wynn Resorts are expected to announce their first-quarter earnings, and various states are looking to advance gambling bills.

Kalshi's legal challenges are particularly noteworthy as they unfold in Massachusetts and Maryland. On May 4, the Massachusetts Supreme Judicial Court will hear oral arguments in a case brought against Kalshi by the state. Earlier this year, a lower court issued an injunction against Kalshi's sports event contracts, but an appellate court subsequently granted a stay, allowing the platform to continue its operations. The case has now escalated to the state's highest court, with the Commodity Futures Trading Commission (CFTC) filing an amicus brief in support of Kalshi, asserting that event contracts should be under federal jurisdiction.

Shortly after, on May 7, the Fourth Circuit Court of Appeals will hear Kalshi's appeal in Maryland. A federal judge had previously denied Kalshi's request for a preliminary injunction in the District Court for Maryland last August, making this appeal a critical examination of the company's argument regarding federal preemption.

Earlier this year, Kalshi received a favorable ruling from the Third Circuit in its case against New Jersey, while the Sixth Circuit expressed skepticism by denying Kalshi's emergency relief request. Additionally, judges in the Ninth Circuit have raised questions about whether event contracts are subject to federal derivatives oversight in related cases.

In another development, Wisconsin has initiated a lawsuit against Kalshi and other operators, claiming they have breached state gambling laws. The companies have responded by moving the cases to federal court, a tactic they have employed in other jurisdictions. The CFTC has also filed a federal lawsuit against Wisconsin, contesting the state's attempts to apply gambling regulations to prediction markets.

The CFTC has been actively pursuing legal actions to affirm its authority over prediction markets, having filed lawsuits in New York, Connecticut, Arizona, and Illinois. The agency's involvement raises questions about whether it will initiate new lawsuits or join existing ones, particularly in states like Washington, which has taken action against prediction markets.

Furthermore, last week, the U.S. Senate passed a measure prohibiting its members from engaging in prediction markets, citing concerns over conflicts of interest and misuse of non-public information. Senate Minority Leader Chuck Schumer has urged the House of Representatives and the White House to adopt similar measures, leaving it uncertain whether the House will take action on this front.

As the landscape of gambling legislation evolves, more states may push forward with their gambling bills, indicating a dynamic week ahead in the industry.
