Florida legislators made significant efforts to address illegal gambling during the recent legislative session, but ultimately could not resolve key differences before the session concluded on March 13, 2026. As a result, the state’s legal landscape regarding gambling remains uncertain.
Despite advancing several bills aimed at curbing unlicensed gaming machines, online gambling, and sweepstakes-style platforms, lawmakers did not manage to pass a single piece of legislation. One notable bill, SB 1580, was seen as the most promising, having received unanimous support in the Senate early in the month before being amended and passed by the House.
Key aspects of SB 1580 included the establishment of new criminal offenses for individuals who knowingly participate in illegal gambling activities, expanded liability for government employees involved in such operations, and stricter penalties for operating gambling houses. Additionally, it introduced new regulations on internet gambling and created a Limited Slot Machine Surrender Program, allowing operators to relinquish machines in exchange for immunity from prosecution.
However, the House's amendments, which included provisions for legal gambling operations to relocate while maintaining their licenses, necessitated the bill's return to the Senate. With only two days remaining before adjournment, the Senate did not act on the amended version, causing the bill to fail.
Another significant proposal, HB 189, made it to the House floor and aimed to comprehensively address various aspects of Florida’s gambling laws. It sought to explicitly prohibit internet gambling and sports wagering outside of the Seminole Tribe’s compact, increase penalties for gambling-related offenses, and enhance the enforcement authority of the Florida Gaming Control Commission.
Additionally, HB 189 targeted the illegal gambling ecosystem by addressing issues such as the transportation of individuals for gambling purposes and the misrepresentation of machine legality. Although it stalled, some of its provisions were incorporated into SB 1580.
Other proposed bills, including SB 1164 and HB 591, aimed to implement similar restrictions but saw limited progress. SB 204, on the other hand, focused on providing regulatory clarity rather than expanding criminal charges, requiring organizations to seek rulings from the Florida Gaming Control Commission before operating potentially illegal machines.
