EU Court Ruling Impacts YouTube's Gambling Content Liability

A recent ruling from Europe’s highest court has significant implications for YouTube's handling of gambling content, particularly in light of Italy's advertising ban. The Court of Justice of the European Union (CJEU) determined that Google may not be able to invoke EU liability protections for gambling videos uploaded by creators who are part of its revenue-sharing initiative.

The court's decision stems from a fine of €750,000 ($857,000) imposed by Italy's communications authority, AGCOM, due to gambling-related videos on YouTube. Google contested this fine, asserting that the EU's hosting liability exemption should protect it since the videos were uploaded by third parties. However, the CJEU ruled that this exemption may not apply if the platform is actively involved in the content it hosts.

The court clarified that when a platform operator becomes aware of essential content uploaded by users through commercial partnerships, it cannot claim the liability exemption outlined in Article 14 of Directive 2000/31. This ruling could reshape how online platforms manage gambling-related content across Europe.

The dispute began when AGCOM found that certain YouTube channels were promoting gambling sites and incentivizing viewers to share videos of their winnings for monetary rewards. As a result, AGCOM mandated the removal of 630 videos and similar content from the platform.

In response to the Italian court's inquiries, the CJEU ruled that while online gambling advertising itself is outside the directive's scope, hosting such advertisements is not. Consequently, YouTube's activities in hosting gambling ads remain subject to the directive's liability framework.

Furthermore, the court addressed YouTube’s Partner Program, which involves Google sharing ad revenue with creators and vetting channels prior to participation. The judges noted that this review process grants Google sufficient knowledge of a channel's content, potentially nullifying its liability protection.

This landmark ruling could lead to stricter regulations for YouTube and similar platforms regarding gambling content, emphasizing the need for careful oversight in the burgeoning online gambling landscape.
