The General Court in Curaçao has issued an interim ruling regarding claims from the SBGOK fund and two players against the holder of the Curaçao license, Gaming Services Provider, which supplies several online casinos.
The court upheld the legality of the prohibition on the assignment of claims in the user agreements of iGaming operators. It stated that payments to third parties do not allow the operator to verify the recipient of the funds. Furthermore, the court indicated that circumventing this prohibition through debt collection on behalf of a player is not permissible.
Five players have assigned their claims to the fund, while two others are pursuing their cases independently. The amounts in question range from several thousand to tens of thousands of dollars.
Additionally, the court validated the user agreements, noting that a separate function for downloading the terms is not legally required. In a related case involving Usoftgaming N.V., the same court annulled the agreement as the operator failed to demonstrate the ability to retain the conditions of the agreement.
