The Joint Court of Aruba, Curaçao, Sint Maarten, and BES has mandated iGaming operator Raging Rhino N.V. (operating under the brand LuckyDays) to pay approximately €32,000 to an Austrian client. This ruling came on March 10, following earlier decisions by the Vienna courts in January and March 2023, which required Raging Rhino to return lost funds due to the operator's lack of a local license.
Raging Rhino attempted to contest the recognition of the Austrian rulings in Curaçao, citing the Civil Code of Curaçao, which states that voluntarily placed bets cannot be reclaimed. However, the court rejected the operator's arguments, emphasizing that assessments based on public order principles should reflect contemporary values rather than norms from the 19th and much of the 20th century.
This decision reinforces the possibility of recognizing foreign court rulings in Curaçao against operators operating in jurisdictions without a local license.
