The Brazilian Ministry of Finance has issued Resolution 1766, which establishes joint tax liability for financial and payment organizations, as well as advertisers working with unlicensed iGaming operators.
The Secretariat of Prizes and Bets (SPA) and the Federal Tax Service will notify organizations about their dealings with such operators. Following this notification, organizations have 24 hours to block any payments to the unlicensed operator.
If an organization continues to process transactions after the notification, it will share tax liability with the operator. For advertisers of unlicensed operators, no notification is required; liability is immediate.
In all cases, the procedure is conducted administratively, with the right to defense, and the resolution takes effect upon publication.
