The Brazilian Ministry of Finance has initiated a 45-day public consultation to gather feedback on proposed modifications to the authorization process for fixed-odds betting operators. This move is part of the government's efforts to enhance transparency within the country's regulated gambling sector.
The consultation period is set from July 27 to September 9, 2026. Both individuals and organizations can submit their comments via the Brasil Participativo Portal, requiring a gov.br account for access. Following the conclusion of the consultation, the Secretariat of Prizes and Bets (SPA) will review the feedback in accordance with Article 31 of Decree No. 12,002/2024.
This initiative follows the Ministry's recent release of Administrative Order No. 2,126, which formed a task force dedicated to ensuring clarity in the licensing processes for gambling companies. In June, Finance Minister Dario Durigan announced plans to publish over 25,000 documents related to betting authorization, reinforcing the government's commitment to transparency.
The Public Consultation Notice SPA/MF No. 3/2026 was published in the Federal Official Gazette on July 22, 2026, in Edition 136, Section 3, Page 182. The notice indicates that the consultation aims to collect insights and information for drafting an ordinance that will set forth the rules and conditions for obtaining authorization to operate fixed-odds betting lotteries commercially.
The SPA seeks contributions to aid in formulating revised regulations for commercial authorization of sports betting and online gaming in Brazil. This review aims to refine the authorization application process currently outlined in SPA/MF Ordinance No. 827/2024.
Ordinance No. 827 established the requirements and conditions for authorizing betting businesses under Brazil's gambling legislation. The SPA intends to incorporate lessons learned from the first authorization cycle into the new framework.
This regulatory review was included in the SPA Regulatory Agenda, established by Ordinance No. 817 in April 2025, which anticipated a review of betting operator authorization procedures in the first quarter of 2026. However, the consultation was not made available online until July.
The notice was issued under the authority granted by Article 55, caput, item I, of Annex I to Decree No. 11,907, dated January 30, 2024. It also references Law No. 13,756 from December 12, 2018, Law No. 14,790 from December 29, 2023, and Article 29 of Decree No. 12,002 from April 22, 2024.
The goal of this consultation is to allow public participation before the government finalizes the regulations that will define the authorization requirements for the commercial operation of fixed-odds betting lotteries.
